Impact is the average of the four parts, rounded, plus one point when Canada is directly hit on two or more channels, up to 10.

What changed

Dated, newest first

  1. Mexico is to send evidence within a week of each date in the Penasquito plan; no USTR notice of completion was found by late morning on 28 Oct 2026. [12]
  2. USTR's case page lists 16 facilities with steps dated in 2026 and no remedy in any case (Strature's count, as of 25 Oct 2026). [2]
  3. Course of remediation at Newmont Penasquito, due by 28 Oct 2026, includes reinstating two workers with full back pay. [5]
  4. USTR asked Mexico to review GLM Components (8 Oct 2026) and Carolina Performance Fabrics (13 Oct 2026); a request for review is not a finding that rights were denied. [8]
  5. Comments on the 2027 USMCA joint review are due 12 Jan 2027; no hearing date set. [9]

Why it matters

The US uses the USMCA's Rapid Response Labor Mechanism often but has never applied a remedy. Two panels have found a denial of workers' rights, at Atento (2025) and Camino Rojo (2026), so a remedy is legally open in both. A first remedy would be small in trade value but a sharp signal before the 2027 joint review.

Why Likelihood 3 Pushes: a 'severe' finding at Camino Rojo; Greer's pledge to use the RRM 'to the fullest extent'; a busy docket. Brakes: no remedy ever recorded; none has followed the Atento or Camino Rojo findings, and other cases settle before a panel; a remedy could sour the 2027 review.

The other facts on file (3)
  • After a panel finding, remedies may be imposed on 5 business days' notice; denial of entry needs prior findings on at least two occasions. [1] (1 Jul 2020)
  • USTR published a panel finding of a 'severe' denial of rights at Orla Mining's Minera Camino Rojo; nine remedies proposed. [3] (26 Mar 2026)
  • A panel found a denial of rights at Atento Servicios, Hidalgo (determination 4 Jul 2025, announced 21 Aug 2025). [2] (21 Aug 2025)

How it spreads

If

Between 26 Oct 2026 and 25 Oct 2027, the US imposes a remedy under USMCA Annex 31-A Article 31-A.10 (removal of tariff preference, penalties, or denial of entry) on goods or services of a facility in Mexico.

Channels 4 on the card

  1. CanadaNot a party to the US-Mexico mechanism.
    More

Orla Mining, a Canada-based company, owns the Camino Rojo mine named in the panel finding.

  2. Trade with MexicoUS imports from Mexico were US$534.31bn in 2025 [11]; one facility is a tiny share, but a remedy shows the mechanism can bite.
  3. Rules and complianceLabour risk at Mexican plants becomes priced, not only reputational.
  4. The 2027 reviewA remedy before 12 Jan 2027 [9] would put labour enforcement on the review agenda (Strature's view).

Three scenarios and their signposts

  1. S1

    Settle and close

Every case ends in a course of remediation, as in October 2026.

  2. S2

    A first remedy

USTR gives 5 business days' notice and suspends tariff preference or imposes a penalty at a facility with a panel finding.

  3. S3

    Folded into the review

Labour remedies become a bargaining chip in the 2027 joint review.

The signposts of each scenario
PathSignpost
S1Mexico agrees to review GLM and Carolina and the 45-day reviews end with plans
S2A USTR notice under Article 31-A.9
S3USTR names RRM remedies in its review agenda after 12 Jan 2027

No probability is given for the three paths.

The other side

Settlements raise labour standards and wages in Mexican plants, which narrows the cost gap with Canadian and US plants (Strature's view). A credible, rarely used remedy keeps the mechanism working without a trade fight.
