Why it matters

Since 29 Sep 2026 patented medicines from the EU have paid a US duty of 15% in all, against a default of 100% for countries without a deal. The same proclamation lets Washington raise a partner's rate if it fails to keep its commitments. In Strature's view Ireland is the EU member most exposed: its medical and pharmaceutical exports were EUR 51.6bn in January-August 2026, and RSM's chief economist says over half its corporate tax comes from 10 multinationals.

Why Likelihood 4 Pushes: clause 3(f) and paragraph 13 of the proclamation allow a rise; the German case; the US push for onshoring and pricing deals. Brakes: the EU rate was set only seven months ago; Section 232 drugs are kept out of the Section 301 duty on EU goods.

Why Impact 5 Threshold case a rate a little above 15% on EU patented medicines.

The other facts on file (3)
  • Section 232 proclamation: 100% default on patented medicines; 15% for the EU, Japan, South Korea, Switzerland-Liechtenstein; 20% onshoring tier; 0% with MFN pricing deal until 20 Jan 2029; clause 3(f) allows a rate rise for failure to fulfil commitments; generics excluded at this time [1] (2 Apr 2026)
  • USTR Section 301 investigation of Germany's underpayment for innovative drugs initiated 18 Jun 2026 [7] (24 Jun 2026)
  • Commission: 2025 GDP +12.3% driven by pharma exports likely front-loaded ahead of US tariffs; 2026 -1.2%; tax concentration in pharma and ICT a major risk [8] (21 May 2026)

How it spreads

If

Between 26 Oct 2026 and 25 Oct 2027, the total US duty on patented medicines from the EU rises above 15% for at least one day, by a change to the Section 232 rate or by any other duty added on top.

Channels 4 on the card

  1. CanadaNo Canadian loss sourced; Canada's C$4.93bn of imports from Ireland in 2025 [9] are not touched by a US duty.
  2. Irish public financesA higher duty would test the EUR 39bn corporation-tax forecast for 2027 [5]; RSM's chief economist says over half of corporate tax comes from 10 multinationals [6].
  3. Trade and outputMore pressure to move production to the US, which the 20% and 0% tiers already reward [1].
  4. The EU-US dealA rise would signal the 15% all-in rate [2] is no longer a ceiling.

Who is exposed

Three scenarios and their signposts

  1. S1

    The deal holds

The 15% rate stays and more firms move to the 20% or 0% tiers through onshoring and pricing deals.

  2. S2

    A partial squeeze

The EU rate stays but generics are tariffed after the April 2027 review.

  3. S3

    The ceiling breaks

Washington finds the EU short of its commitments and raises the rate under clause 3(f), or the German drug-pricing case ends in a duty that reaches medicines.

The signposts of each scenario
PathSignpost
S1No Federal Register notice changing the EU rate by 2 Apr 2027
S2The Commerce report on generics
S3A US finding against the EU in any trade case

No probability is given for the three paths.

The other side

The 15% rate is far below the 100% default [1], which leaves EU-made medicines cheaper to ship to the US than those of countries without a deal. Ireland's growth outlook rests on solid global demand for the medicines it makes, in the Commission's words [8].
