Why it matters
On 24 Jul 2026, the day after the EU fined Google EUR890m under the Digital Markets Act, the President said USTR would open a Section 301 case on EU fines on US tech firms. Three months later no initiation notice has been published. The next EU fine or order under the DMA, the Digital Services Act or the AI Act, whose enforcement began on 2 Aug 2026, could bring the case.
Why Likelihood 4 Pushes: the President's promise of 24 Jul 2026, USTR's Dec 2025 threat, the Germany case and the Brazil precedent of a digital case ending in tariffs, more DMA, DSA and AI Act enforcement ahead, the 2019-2020 digital tax cases on EU members.
Why Impact 5 Threshold case: a case opened, no tariff yet.

The other side
European cloud, software and AI firms could gain if the DMA opens markets that US platforms now control. A negotiated settlement could also give firms on both sides clearer digital rules.
